vraagt Uw aandacht voor het volgende:
De afgelopen maanden is er in het algemeen bestuur en met het dagelijks bestuur van het Waterschap Brabantse Delta gesproken omtrent de bevoegdheden van het algemeen respectievelijk het dagelijks bestuur.
De discussie startte in de Algemene Bestuursvergadering van 27 juni 2007 met een bijdrage van de dijkgraaf die erop neerkwam ‘dat van de “Design and Construct”-methode van aanbesteding in de toekomst meer gebruik gemaakt zal gaan worden, omdat het dagelijks bestuur ontwerp- en bestekactiviteiten meer wenste te gaan uitbesteden’.
Ondergetekende concludeerde dat dit voornemen een wijziging was van het uitbestedingsbeleid en vroeg het dagelijks bestuur dit, klaarblijkelijk, nieuwe aanbestedingsbeleid middels een nieuwe nota aanbestedingsbeleid voor te leggen ter vaststelling aan het algemeen bestuur. Deze conclusie en dit verzoek waren en zijn gebaseerd op artikel 77 van de Waterschapswet: “De in artikel 56 omschreven bevoegdheid tot regeling en bestuur berust bij het algemeen bestuur voor zover deze niet bij of krachtens reglement dan wel bij wet of bij algemene maatregel van bestuur is toegekend aan het dagelijks bestuur, aan de voorzitter of aan het bestuur van een afdeling.”.
Het dagelijks bestuur is van mening dat het aanbestedingsbeleid haar bevoegdheid is. Zij voert daartoe een aantal argumenten aan, o.a. in de adviesnota aan het algemeen bestuur, registratienummer 071002230: “Het vaststellen van het aanbestedingsbeleid is op dit moment (nu het AB het aanbestedingsbeleid tot op dit moment niet expliciet heeft voorbehouden) de bevoegdheid van het DB.”.
Ondergetekende acht dit volstrekt tegengesteld aan wat de wetgever middels artikel 77 van de Waterschapswet heeft bepaald. Een dergelijke uitleg van de bevoegdheid van het DB is, mijns inziens, een omdraaiing van handelen. Volgens mijn interpretatie van artikel 77 is het AB bevoegd, tenzij het AB deze bevoegdheid expliciet heeft overgedragen. Dit is tot op heden niet het geval.
Een tweede argument van het dagelijks bestuur is haar uitleg van artikel 15 lid f en g van het door Provinciale Staten vastgestelde Reglement van waterschap Brabantse Delta:
artikel 15 lid f: “de vaststelling van de bestekken en van de voorwaarden van aanbesteding van voor het waterschap uit te voeren werken en te verrichten leveringen en van de voorwaarden van verkopingen, voorzover het algemeen bestuur zich die vaststelling niet heeft voorbehouden.”.
artikel 15 lid g: “het houden van alle aanbestedingen van werken, diensten, leveringen en verkopingen, tenzij het algemeen bestuur anders heeft beslist.”.
In de interpretatie van ondergetekende hebben deze artikelen betrekking op de uitvoering van het beleid. Niet op de vaststelling van beleid als zodanig. Onder ‘voorwaarden’ zoals vermeld in artikel 15 lid f verstaat ondergetekende o.a.:
– wanneer offreren
– deskundigheidsvereisten aannemers
– kredietwaardigheid aannemers
– juridische status
– wie uitgenodigd worden bij onderhandse aanbesteding
– enz.,
maar zeker niet beleidsonderdelen, zoals:
– welke bedragen/grenzen enkelvoudige onderhandse aanbesteding
– welke bedragen/grenzen meervoudige onderhandse aanbesteding
– welke bedragen/grenzen openbare aanbesteding
– hoe om te gaan met Design and Contract met effecten op de bezetting en kwaliteit/
deskundigheid van en op de eigen organisatie
– enz.
De Kroon is middels de Minister die het aangaat toezichthouder en handhaver van de wetten en regelingen des lands. In dit kader vraag ik uw oordeel op de voornoemde interpretatie van de Waterschapswet, alsmede het door Provinciale Staten vastgestelde Reglement door het dagelijks bestuur van het waterschap Brabantse Delta.
