Geacht College,
Op het gebied van water zijn er veel ontwikkelingen die grotendeels voortkomen uit het geformuleerde en te formuleren beleid van hogere en andere overheden.
Voor de D66/BSD-fractie leidt dit tot het aangeven van een aantal suggesties c.q. vragen
Waterketen
De landsregering wil komen tot een aanzienlijke besparing in de totale waterketen, waarbij samenwerking en een waterketenbedrijf tot de mogelijkheden zouden kunnen behoren.
In Gelderland loopt in dit kader een breed initiatief, waar alle overheden en het waterbedrijf de waterketen vorm aan het geven zijn met het oogmerk tot aanzienlijke besparingen te komen.
In een bestuurlijke werkgroep, waarin zeven gemeenten, alle Gelderse waterschappen, de Provincie en het waterbedrijf vertegenwoordigd zijn, worden de plannen uitgewerkt.
Startpunt is o.a. het gegeven dat reeds 10 jaar in een twaalftal Gelderse gemeenten één waterketennota verstuurd wordt door het waterbedrijf, waar ook de waterschapsheffing en het rioolrecht (op basis van het drinkwaterverbruik) in verwerkt zijn.
1.Is Uw College bekend met dit Gelders initiatief?
2.Is Uw College bereid in West-Brabant initiatiefnemer te worden om dit ook hier van de grond te krijgen?
Grondwaterrichtlijn
Er komt een Europese Grondwaterrichtlijn, waardoor (als de voortekenen ons niet bedriegen) de gemeenten de formeel wettelijke grondwaterzorgplicht op hun bordje zullen krijgen. Of hier sprake zal zijn van een resultaat- of inspanningsverplichting is nog niet duidelijk. Helder is wel dat de risico’s door claims voor de gemeente aanzienlijk zullen stijgen.
In de Tweede Kamer zijn al partijen (o.a. Van Lith van het CDA) die stellen dat de watertoets een zwaarder gewicht zou moeten krijgen. Zeker de plannen rond de Augustapolder en de Bergse Haven verdienen in dit kader onze aandacht.
1.Is er bij de opzet van deze plannen reeds rekening gehouden met deze Europese grondwaterrichtlijn in wording en hoe worden de toenemende risico’s afgedekt?
Europese Kaderrichtlijn Water (KRW)
De KRW is voor iedere waterbeheerder een doos van Pandora.
De kosten zullen, over de hele waterketen bezien, aanmerkelijk stijgen. Naar het gevoelen van de D66/BSD-fractie wordt dit door de meeste overheden enorm onderschat.
Veel waterbeheerders denken dat de implementatie vertraagd zal worden c.q. dat het beperkt zal blijven tot een inspanningsverplichting. Deze gedachte is ingegeven door onze min of meer gedoogcultuur. Met Europese regelgeving is dit anders. Die is gebaseerd op handhaving naar de letter!
Nu reeds heeft de Europese Commissie Nederland gedaagd voor het Europese Hof van Justitie wegens het niet (tijdig) omzetten van de KRW in wetgeving.
Uit de ambitienota van het kabinet blijkt dat zij rekening houdt met een verdubbeling (in euro’s van nu) van de zuiveringslasten (waterkwaliteitsheffing) tot 2015. Tevens heeft het CPB aangegeven zelfs niet in ruwe termen iets te kunnen zeggen over de kosten van de KRW (bron: quick scan CPB).
Alleen al de zuiveringslasten betekenen 150 Ã 200 euro per gezin per jaar meer lasten.
Zoals de wetgeving nu luidt, betekent dit ook voor gemeenten verder sterk stijgende kosten voor bijvoorbeeld riolering vanwege verdergaande eisen (mogelijk kan/mag niet meer) aan aard en aantal overstorten.
De enige temporiseringroute (derogatie) is een economische. Uit de in omloop zijnde stukken blijkt dat tot op heden er geen economische effect analyse is gemaakt. Ook in het landelijk bestuurlijk overleg water (LBOW), waarin de gemeenten via de VNG vertegenwoordigd is, speelt de economische effectanalyse (nodig voor derogatie) geen rol.
1.De D66/BSD-fractie verzoekt Uw College dringend middels de VNG de noodzaak van een economische effect analyse in te brengen in het LBOW.
2.Tevens verzoekt de D66/BSD-fractie Uw College dringend te overwegen alle nog in het beheer van de gemeente zijnde watergangen zo spoedig mogelijk over te dragen aan het waterschap. De kosten van het beheer van watergangen, zowel van uitvoering als beleid, zullen zeker scherp stijgen.
