DE NIEUWE NATUURBESCHERMINGSWET
De Pal-lezing in Den Haag op 20 mei 2016 ging over de nieuwe natuurbeschermingswet. Met deze wet worden veel bevoegdheden van het Rijk overgedragen aan de provincies. Provinciaal ambtenaar Willem Lambooij gaf in grote lijnen aan wat de nieuwe wet aan veranderingen bracht. Feitelijk worden de flora en faunawet, de boswet en de huidige natuurbeschermingswet in één wet bijeengebracht. De beoogde invoeringsdatum is 1-1-2017. Per 1-1- 2018 zal deze nieuwe wet weer opgaan in de omgevingswet. De wet is, in mijn ogen, op onderdelen een forse verandering. Zo wordt de bevoegdheid tot vergunningverlening voor ruimtelijke ingrepen overgeheveld van het Rijk (EZ) naar de provincies. Dit geldt ook voor de regels inzake faunabeheer/faunafonds. Er worden veranderingen doorgevoerd omtrent de te beschermen soorten. Zo vervalt de bescherming van een aantal vissen, waaronder de kleine modderkruiper.
De natuurbeschermingswetgeving, die min of meer startte met de vogelwet in 1938, gaat er fors anders uitzien. Nu is de vraag: gaan de provincies het verschil maken? Deze nieuwe wet is gedoemd snel op te gaan in de omgevingswet. In de nieuwe natuurbeschermingswet krijgen de provincies de opdracht een natuurvisie te maken. Een aanwezige gedeputeerd zei dat dit middels de omgevingswet zal gaan gebeuren. Voor mij de vraag of de bescherming van soorten dan wel die aandacht zal krijgen zoals nu het geval is. Naar mij gevoel wordt onvoldoende beseft dat om vogels te beschermen je ook hun voedselbronnen moet beschermen. Een voorbeeld: als we kieviten willen behouden, zullen er ook voldoende voor hen eetbare insecten moeten zijn in de periode dat zij hun jongen grootbrengen, anders raken we meer kwijt dan we nu vermoeden.
In de discussie kwamen er veel zorgen uit de zaal. Ook over beheer, toezicht en handhaving. Vooral als met de invoering van de omgevingswet per 1-1-2018 gemeenten dat moeten gaan uitvoeren. Ik deel die zorgen. Gemeenten bezuinigen op veel zaken en bij de afweging met andere zaken verwacht ik niet dat beheer/toezicht en handhaving dan die prioriteit krijgen die nodig is. Was de veldpolitie er nog maar. Toen was het echt beter geregeld!
