KADERRICHTLIJN WATERDOELSTELLINGEN
Op 13 juni is er een onderzoeksrapport verschenen met de titel; “Zover het eigen instrumentarium reikt“. Het is een onderzoek naar de positie van de provincie Noord-Brabant en de Noord-Brabantse waterschappen bij de realisatie van de kaderrichtlijn waterdoelstellingen met bijzondere aandacht voor de omgevingswet. Het rapport is wat mij betreft nuttig voor iedere waterschap- of provinciebestuurder. Ik beveel dan ook aan dit rapport te lezen. Hierbij is het belangrijk te focussen op de eigen taak, maar ook op wat de mogelijkheden tot beïnvloeding zijn. Wat mij betreft hoort daar ook de vraag bij in hoeverre de kaderrichtlijnwater (KRW) technisch/financieel/economisch haalbaar is? En als het antwoord nee zou zijn, de vraag hoe en wanneer gaan we dit bestuurlijk in discussie brengen?
In de samenvattende pagina’s wordt op pagina 90 verwezen naar hoofdstuk V, waar is ingezoomd op de vraag of ten aanzien van het stikstofdossier een op slot risico kan bestaan of ontstaan bij vergunningverlening of het vaststellen van maatwerkvoorschriften. Wat betreft de vergunningverlening is geconstateerd dat voor de landbouw de mestverwerkinginstallaties onder de vergunningsplicht vallen. De stikstofproblematiek, voor zover afkomstig uit de landbouw, wordt voornamelijk veroorzaakt door niet-vergunningsplichtige activiteiten die algemeen gereguleerd worden. Omdat de provincie en waterschappen ten aanzien van deze activiteiten geen ‘go of no-go-beslissing’ kunnen nemen, zal zich ten aanzien van deze activiteiten in beginsel geen ‘op slot-risico’ voordoen.
Wat mij het meest verontrust is de volgende passage (pagina 90) : “Met name een vergunning voor een bestaande activiteit (vanwege het verlopen van de huidige vergunning) waarbij een belasting wordt toegelaten die boven de in het waterplan voor het waterlichaam verankerde stikstofwaarde is gelegen, kan een probleem vormen wanneer de kwaliteit van het oppervlaktewater onvoldoende is en niet kan worden aangetoond dat de betreffende waarde en daarmee de vereiste fysisch chemische kwaliteit wel gehaald zal gaan worden.. In een dergelijk geval is verdedigbaar dat de vergunningverlening het realiseren van de KRW doelstelling in de weg kan staan, waarmee vervolgens verdedigbaar is dat de vergunning moet worden geweigerd. Er is in derhalve wel sprake van een ‘op slot-risico’, vooral omdat er in bepaalde waterschappen inderdaad vergunningen zijn en worden afgegeven die lozingen toestaan die leiden tot stikstofconcentraties die substantieel boven de KRW stikstofwaarde van de betreffende waterlichamen liggen”. Een ‘op slot-risico’ voor een bestaande activiteit kan enorme gevolgen hebben ook op de werkgelegenheid! Gecombineerd met de PAS doelstellingen/maatregelen (ik schreef daar eerder op 22 maart over) liggen hier reële risico’s voor economische schades als er te weinig invulling wordt gegeven aan de KRW doelstellingen en de terugdringing van de huidige stikstofbelasting van het milieu. Wel zal, meer dan tot nu toe, naar de haalbaarheid van de doelstellingen gekeken moeten worden. Niets is meer frustrerend dan veel geld uitgeven en de doelstellingen niet te kunnen halen. Vooral het one out, all out is in mijn visie een groot obstakel, waar wat mij betreft de bestuurlijke discussie snel over moet starten om de doelstellingen eventueel aan te passen en het draagvlak voor maatregelen en investeringen te vergroten.

In de avond de bijeenkomst van de werkgroep bestuurlijke vernieuwing met als belangrijkste agendapunt: sturen op hoofdlijnen. Hierbij is gekeken naar hoe de huidige wijze van agenderen van de algemeen bestuursvergadering zou kunnen veranderen om meer op hoofdlijnen te gaan besturen. Tevens werden de laatste algemene beschouwingen geëvalueerd.
