Geacht Dagelijks Bestuur,
In het algemeen is het onverstandig wateren, zoals de Groote Melanen, te baggeren in het voorjaar. Op dat moment zitten er mogelijk nog overwinterende amfibieën in de modderlaag verscholen en trekken ook de op het land overwinterende amfibieën naar het water om er hun eitjes af te zetten. Ook voor de meeste vissen is dat het seizoen om hun eitjes af te zetten. Op grond van de algemene zorgplicht, die ook het waterschap heeft, op grond van de Flora- en faunawet is het voorjaar over het algemeen daarom een zeer onverstandige periode om te baggeren. Gaan baggeren terwijl het vervuilende water uit de om te leiden Jankenbergloop en de sloot vanaf het volkstuinenterrein in de Groote Melanen blijft stromen is raar. De werkvolgorde omdraaien is uiteraard veel logischer.
Alle amfibiesoorten zijn wettelijk beschermd en als er zwaarder beschermde soorten voorkomen mag er alleen met een ontheffing in het voorjaar gebaggerd worden. Op Waarneming.nl staat aangegeven dat in het gebied Groote Melanen de Rugstreeppad voorkomt: dat is zo’n zwaarder beschermde soort waarvoor niet zonder ontheffing mag worden gebaggerd. Het waterschap en de gemeente zijn daar door de lokale IVN- afdeling ook op gewezen. Tevens is op de recente informatieavond gevraagd om inzage in het uitgevoerde flora- en faunaonderzoek. Dat is naar mijn informatie nog niet beschikbaar gesteld. Recent is aan een vertegenwoordiger van de IVN- afdeling medegedeeld dat de Rugstreeppad niet in de Groote Melanen zelf, maar 100 meter verderop was aangetroffen en dat er daarom toch in het voorjaar gebaggerd kan worden. Amfibieën zijn mobiel en het feit dat de Rugstreeppad niet in de Groote Melanen is aangetroffen, is geen enkele garantie dat die soort daar niet voorkomt. Zeker in het voorjaar trekt de Rugstreeppad naar water om zich voort te planten.
- Wat is de reden dat nu besloten is te baggeren in het voorjaar?
- Is uitstel tot het najaar mogelijk?
