Risico’s regenwater
Afkoppelen van daken en andere verharde oppervlakken is nodig om beter en kosteneffectief om te kunnen gaan met de zwaardere buien die de afgelopen jaren in omvang en frequentie toenemen. Het is nodig om overstorten in oppervlaktewater en wateroverlast in lager gelegen delen van een bebouwde kom te voorkomen. Het is niet zo dat regenwater afkomstig van verharde delen volledig schoonwater is. Het is echter veel minder verontreinigd dan het water dat bij een overstort van het rioolsysteem in het oppervlaktewater terecht komt of het water dat bij een zware bui uit de riolen omhoog gekomen op straat blijft staan.
Regenwater van daken en wegen bevat echter wel zaken als fijnstof dat afkomstig is van bijvoorbeeld de uitlaten van auto’s. Het bevat ook tal van bacteriën afkomstig van honden- en vogelpoep. Ook bevat het lood uit de banden van auto’s of zink van goten en vangrails, alsmede PAK’s (polycyclische aromatische koolwaterstoffen) onder andere afkomstig van verbrandingsmotoren. Het is helder: afgekoppeld regenwater is niet van een kwaliteit om in te zwemmen of te spelen. Afkoppelen heeft een meerwaarde maar is niet risicovrij. Het is aan te bevelen om afgekoppeld regenwater bij voorkeur via een vaste voorziening zoals een wadi te infiltreren in de bodem of via een helofytenfilterachtige constructie in oppervlaktewater.

Samen met DB collega Jacques van der Aa naar het PAS (Programmatische Aanpak Stikstof) symposium geweest in het Provinciehuis in Den Bosch. Een heel informatieve bijeenkomst. Maar die ook laat zien dat er op het gebied van de beperking van de stikstofuitstoot (stikstofnitraat, stikstofnitriet, ammonia en stikstofoxiden) nog heel veel moet gebeuren en dat de druk om tot daden te komen hoog is. Op basis van de natuurbeschermingswetgeving is feitelijk in veel gebieden geen ontwikkeling van nieuwe economische activiteiten die leiden tot extra uitstoot meer mogelijk. De provincie erkende, bij monde van één van de presentatoren, dat door het (beperkt) toestaan van een aantal nieuwe activiteiten deze stikstofuitstoten een hypotheek wordt genomen op de toekomst. Vandaar dat een fors aantal maatregelen tussen nu en 2021 genomen moeten worden om de belasting/gevolgen van/op een aantal Natura 2000 gebieden terug te brengen. Voor het werkgebied van het waterschap Brabantse Delta zijn er ingrijpende maatregelen nodig voor de N 2000 gebieden Westelijke Langstraat en de Loonse en Drunense duinen (deels waterschap de Dommel). Ik kan als gebiedsportefeuillehouder mijn borst nat maken. Maar de maatregelen zijn nodig, omdat anders veel gebieden rond deze N 2000 gebieden in 2021 economisch op slot gaan.

Soms bezoek je een seminar waarbij je als gemeenteraadslid en als dagelijks bestuurder van een waterschap van de ene verbazing in de andere valt. Zo’n seminar was “van reststof naar bouwstof“. Het seminar werd georganiseerd door Immobilisatie. De dagvoorzitster was Noortje Schrauwen die verbonden is aan Grondstofjutters, een organisatie waarbij de circulaire economie de leidraad is. Er waren vele interessante sprekers waaronder Chris Schuurbiers van de Inspectie Leefomgeving en Transport en Jurgen Lutterman van SGS Intron, de certificeerder.
Immobilisaten hebben mijn belangstelling, omdat zij rest-/afvalstoffen bevatten die door immobilisatie uiteindelijk weer middels constructies in het milieu worden gebracht. Op basis van de presentaties van deze twee heren kwam ik tot de conclusie dat het fabricageproces en de immobilisaten als producten duurzaam en milieutechnisch verantwoord tot stand komen. Wetgeving en de certificering lijken afdoende om in hoge mate erop te kunnen vertrouwen dat het in de bouw toe te passen product betrouwbaar tot stand komt.
Toepassing lijkt een geheel ander verhaal. De Inspectie Leefomgeving en Transport controleert en handhaaft tot en met de totstandkoming van het immobilisaat. De controle en handhaving daarna is aan het betreffende bevoegd gezag (gemeenten en waterschappen). Op mijn vraag hoe de overdracht van de handhaving van de Inspectie Leefomgeving en Transport naar de gemeenten of de waterschappen geregeld was of plaatsvond kwam van Chris Schuurbiers met het verbijsterende antwoord: niet! Overdracht van de handhaving was niet geregeld en het vond ook niet plaats. Let wel: we hebben het over producten die tot 25 % ernstig verontreinigd afval kunnen bevatten. Als het immobilisaat als product bereid is, is het formeel geen afval meer maar bouwstof! In de zaal waren een fors aantal handhavers, in dienst van de omgevingsdiensten (van Groningen tot Zeeland, inclusief West-Brabant) aanwezig. Zij bevestigden deze feiten.
De presentatie van Chris Schuurbiers bevatte een aantal voorbeelden van wat er bij de toepassing van de immobilisaten milieutechnisch fout kon gaan. Als uitgehard product zijn de toepassingen milieutechnisch verantwoord. Maar soms liggen de vers gestorte immobilisaten dagen onafgedekt uit te harden. In net aangebrachte en nog niet uitgeharde toestand lijkt het materiaal dan op gewone grond die voor kinderen uitnodigend kan zijn om op of in te spelen. Omdat bij de uitharding soms grote hoeveelheden water worden gebruikt kan dit, zolang het materiaal niet is uitgehard, uittreden waarbij uitgeloogde verontreinigingen in het riool of oppervlaktewater terecht kunnen komen. Handhaving is hier nodig, maar dan moet een gemeente of een waterschap wel weten waar dergelijk materiaal wordt gebruikt. Nu wordt het gebruikt (circa 600.000 ton per jaar oplopend tot 1.000.000 ton in 2020) in tal van toepassingen (wegen, fietspaden, funderingen, parkeerplaatsen, vloeistofdichte vloeren, sportvelden, keerwanden, kades enz.). Ook vind er geen registratie plaats waar dergelijke materialen zijn gebruikt. Dit terwijl de totale branche (zes gecertificeerde bedrijven) zegt dat graag te willen. Hier ligt een taak voor de landelijke overheid dit te regelen.
Over de kansen daartoe hielp handhaver Chris Schuurbiers ze snel uit de droom. ‘Ze vinden in politiek Den Haag dat de milieuwetgeving af is met de omgevingswet’, was zijn reactie. De politiek wil ook geen lastenverzwaring voor het bedrijfsleven. Curieus was dat de zes bedrijven waar het over ging het zelf wel willen. Registratie waar welk immobilisaat is gebruikt, is om in de toekomst, als het door aannemers tot stand gebrachte product aan het eind van zijn levensfase is gekomen, dit product verantwoord te kunnen slopen en her te gebruiken. Dat is pas een werkelijke invulling van een duurzame circulaire economie.
Misschien is het goed als gemeenten en waterschappen, dus Unie en VNG in Den Haag, gaan bepleiten dat registratie van wat eens risicovolle afvalstoffen waren, ook als toegepast immobilisaat noodzakelijk en bedrijfseconomisch verantwoord is.
