De kerst/oud jaar-periode is een periode van lezen voor mij en van achterstanden inhalen. Ook van het lezen van artikelen die anderen mij toesturen of bij mij in de brievenbus gooien. Zo werd ik gewezen op een artikel in het Streekblad Zoetermeer dat gaat over een milieuvriendelijke aanpak van blauwalg in de Zoetermeerse Plas. Het betreft een systeem (van LG Sonic) dat met ultrasone geluidsgolven als het ware op maat de eventuele blauwalgen bestrijdt. Het is een project dat in de gaten gehouden moet worden om, bij bewezen succes, in de Nederlandse situatie verdere navolging te krijgen.
Ik heb een boek met de titel: “Henk Saeijs” “Stormloper in een delta” opgetekend door Leo Santbergen gelezen. Het is het levensverhaal van Henk Saeijs die een indrukwekkende carrière maakte binnen Rijkswaterstaat. Een lezenswaardig boek. Henk Saeijs promoveerde op het proefschrift “Changing Estuaries”. Hij stelde in dat proefschrift onder andere dat ‘het onverstandig was geweest dat begeleiding van ecosysteemtransformaties geen onderdeel zijn geweest van het ontwerp van het Deltaplan. Ze werden beschouwd als neveneffecten’. Ik onderschrijf die bemerking van harte. De majeure ecosysteemtransformatie van zout naar zoet van zowel het Markiezaatsmeer als van het Volkerak/Zoommeer is niet tot onvoldoende begeleid, noch waren optredende gevolgen voorzien, noch is er adequaat op gereageerd. Zoals ieder proefschrift bevatte ook het van Henk Saeijs een aantal stellingen. Een stelling waarvan ik het belang onderschrijf was: “Als een noodzakelijke stap op weg naar een verantwoord bestuur en beheer van groot oppervlaktewateren dient er in deze gebieden een op functionele ecosystemengrenzen gebaseerde, bestuurlijke (her)indeling plaats te vinden”. Dat is iets wat ook nog steeds niet is gebeurd. Voor mij afschrikwekkende voorbeelden zijn onder andere het Markiezaatsmeer (2 provincies, 2 gemeenten) en de Molenplaat (2 provincies en drie gemeenten). Beide gebieden zijn onbewoond! Dit kan effectiever!
Henk Saeijs heeft ernstige kritiek op het Nederlandse poldermodel. Terwijl de zeespiegel stijgt en de Nederlandse polders dalen. worden de dijken alsmaar hoger en breder met alsmaar grotere gevolgen bij een eventuele dijkdoorbraak. Het houdt in zijn denken een keer op. Het volgende citaat komt uit het boek van Henk Saeijs. Zij is mij uit het hart gegrepen.
“Terwijl het Deltaprogramma tot 2050 inzet op een optimalisatie van de huidige waterveiligheidsstrategie, kan worden nagedacht over het ingang zetten van een transitie naar een ruimtegebruik waarbij de mens, de ‘polderblindheid’ voorbij, weer de hogere, drogere delen opzoekt. Er zijn immers fysieke en financiële grenzen aan alsmaar hogere en bredere dijken langs steeds dieper wegzakkende ‘badkuippolders’. De dijken langs onze rivieren kunnen op langere termijn, in het bieden van veiligheid en om de kosten betaalbaar te houden, niet wedijveren met ruimte voor levende rivieren. Vragen ruimte voor de rivier maatregelen op korte termijn relatief hogere investeringskosten, de maatschappelijke baten zullen zich tot in lengte van jaren ‘uitbetalen’. Ik voorzie, al dan niet noodgedwongen door worst-case klimaatscenario’s, een migratiestroom van het westelijk gelegen sociaal-economisch hart naar de oostelijk en zuidelijk gelegen hogere gronden in Nederland en zijn buurlanden. Terpeneren (zoals in de Overdiepse Polder) en ruimte voor de rivier zullen doorbreken als de dominante combinatiestrategie.”
De meest interessante ‘literatuur’ die ik deze weken gelezen heb was een Europees arrest van het Hof (Grote kamer) over de KRW en de uitdieping van de rivier(mond) van de Wezer tussen de open zee en Bremerhaven. Zowel in het licht van de KRW, een voor de waterschappen een majeure opgave, als voor de eeuwige discussie rond verdiepingen van de Westerschelde is dit arrest van grote waarde.
H.F.M.W. van Rijswick schreef over dit arrest in een noot: “De uitkomst zal velen verrassen, verblijden of tot wanhoop drijven. Het arrest zal in ieder geval enorme consequenties dienen te hebben voor de praktijk van het Nederlandse en het Europese waterbeheer en de rechtspraak zal haar huidige lijn in de jurisprudentie op een aantal wezenlijke punten bij dienen te stellen. Zowel de huidige wetgeving als de in voorbereiding zijnde Omgevingswet zal aangepast dienen te worden aan de uitleg die het Hof geeft aan de KRW, tenzij de wetgever er voor zou kiezen te wachten tot er in een procedure een beroep op de KRW wordt gedaan. Daarmee wordt het probleem echter gelegd op het bordje van de bestuursorganen die de komende jaren besluiten en maatregelen moeten nemen op het terrein van het waterbeheer. Dat is niet erg chique.” De essentie van de uitspraak is: “Lidstaten zijn verplicht om goedkeuring voor een project te weigeren indien het project kan leiden tot een achteruitgang van de toestand van een oppervlaktewaterlichaam.”
Onderstaand een aantal citaten uit het arrest en de noot van Van Rijswick (die voor mij de kern van het arrest en de komende discussies bevatten inzake de mogelijke impact van dit arrest op het beleid van waterbeherende instanties bevatten. Ze zijn slechts een greep uit vele!
Opmerkingen van partijen (onder andere):
“De verwijzende rechter stelt in essentie de vraag of de KRW als beginsel een verbod instelt op achteruitgang van de toestand van alle oppervlaktewaterlichamen, behoudens de uit de KRW voortvloeiende uitzonderingen.”
“De Nederlandse regering is daarnaast van mening dat het KRW een ‘programmatische’ aanpak voorschrijft, in die zin dat de lidstaten bij de uitvoering een grote bewegingsvrijheid hebben.”
“Het staat namelijk vast dat het uiteindelijke doel van de KRW is de vervulling van het criterium van een ‘goede toestand’ van alle oppervlaktewateren en grondwater van de Unie tot 2015.”
Conclusies: A-G N. Jääskinen (onder andere):
“Gezien het voorgaande moet worden vastgesteld dat de KRW weliswaar geen volledige harmonisatie bewerkstelligt, maar evenmin beperkt blijft tot een uitsluitend ‘programmatische benadering’, die aan de lidstaten een grote discretionaire bevoegdheid zou overlaten wat beleidskeuzes en beoogde of vast te stellen maatregelen betreft.”
“Het verbod van achteruitgang vormt in feite zowel een verbod als een stimulerende norm, gericht op het bereiken van de in de KRW in haar geheel voorgeschreven resultaten. De lidstaten zijn zodoende niet slechts gehouden om iedere achteruitgang te verbieden, maar ook om dit verbod op doeltreffende wijze te handhaven. De doeltreffende tenuitvoerlegging van de doelstelling om alle achteruitgang te voorkomen, hetgeen de concrete vertaling vormt van de algemene beschermingsverplichting in artikel 1 KRW, is uitsluitend mogelijk door middel van concrete maatregelen die gericht zijn op het voorkomen van achteruitgang en van verstoringen die significante effecten kunnen hebben op de mogelijkheid de in de richtlijn vastgestelde doelstellingen te bereiken.”
Het kan haast niet anders of dit arrest zal forse gevolgen gaan krijgen op het beleid van waterbeheerders en mogelijk ook op (toekomstige) verdiepingen van de Westerschelde.
