Geachte College,
Recent zijn een aantal stukken verschenen die van belang zijn voor het waterbeleid in en rond onze gemeente met in meer of mindere mate grote effecten op het totale gemeentelijke beleid en het beleid rond water in het bijzonder.
Een aantal van die stukken leiden voor de D66/BSD-fractie tot een aantal vragen/bemerkingen, te weten:
1.Karakterisering Stroomgebied Schelde
2.Richtlijnen voor het milieu effectrapport Waterkwaliteit Volkerak-Zoommeer, inclusief beantwoording inspraakreacties
3.Aspectenstudie water en bodem Bergse Haven
Ad A Karakterisering Stroomgebied Schelde
Dit stuk leidt tot een groot aantal vragen/bemerkingen. Voor de overzichtelijkheid zal de D66/BSD-fractie daar paginagewijs doorheen gaan.
Pagina 17 – paragraaf 2.3 Beschermde gebieden
“In beschermde gebieden moeten de doelen van de Kaderrichtlijn Water (KRW) in 2015 gehaald zijn”
“Beschermde gebieden zijn volgens de KRW in ieder geval gebieden die een beschermingsstatus hebben op grond van één of meerdere van de volgende EU richtlijnen:
– Nitraatrichtlijn (91/676/EEG)
– Richtlijn Stedelijk Afvalwater (91/271/EEG)
– Vogelrichtlijn (79/409/EEG)
– Habitatrichtlijn (92/43/EEG)
– Schelpdierwaterrichtlijn (79/923/EEG)
– Viswaterrichtlijn (78/659/EEG)
– Zwemwaterrichtlijn (76/160/EEG)”
Binnen onze gemeente vallen daar in ieder geval onder:
– het Zoommeer/Eendracht systeem (kaart 7)
– de Molenplaat (kaart 7)
– het Markiezaat(meer) complex (kaart 7)
– het dekzandsysteem voor zover er
drinkwater gewonnen wordt (kaart 7)
Wat op kaart 6 (beschermde gebieden zwemwater) opvalt is het ontbreken van de Binnenschelde.
Vragen:
1. Is het ontbreken van de Binnenschelde op de lijst van zwemwaterbeschermde gebieden juist?
2. Is de zwemwaterfunctie van de Binnenschelde vervallen?
3. Uit kaart 25 blijkt dat mogelijk de Molenplaat als enige bij voortgezet beleid de 2015-doelen kan halen. Voor de andere Bergse gebieden is dat niet het geval. De doelen zijn resultaatverplichtingen! Bij verlenging van de termijnen zal gekeken worden naar alle inspanningen die gepleegd zijn. Welke concrete stappen is de Gemeente voornemens om nu reeds te zetten om in 2015 te kunnen zeggen: “we hebben alles wat redelijkerwijs mogelijk was om de doelen te halen, gedaan”?
Pagina 23 – paragraaf 3.2.4 Indeling van beschermde gebieden
“In het stroomgebied Schelde zijn geen afzonderlijke beschermde gebieden aangewezen op grond van de Nitraatrichtlijn of de Richtlijn over Wateronttrekking voor menselijke consumptie”.
Vragen:
4. Is dit juist gezien de onttrekkingen van drinkwater op ons dekzandsysteem?
5. Op kaart 9 staat de vermoedelijke Nedalco-onttrekking aangegeven als voor menselijke consumptie. Op kaart 22 als een industriële winning! Wat is juist en wat wordt de status van de Nedalco-winning na het vertrek van Nedalco? Is de winningvergunning verkoopbaar en/of anderszins overdraagbaar?
Pagina 31 – paragraaf 4.2.3 Indeling van grondwaterlichamen
“Grondwaterlichamen met drinkwateronttrekking moeten worden opgenomen in het register van beschermde gebieden en krijgen zwaardere milieudoelstellingen”
Vragen:
6. In het verlengde van vraag 5: met welk intrekgebied rond de Nedalco-winning zou met voortgezette winning rekening gehouden moeten worden bij de uitwerking van de plannen rond de Bergse Haven?
7. Kan het gestelde in paragraaf 4.2.3 leiden tot een ander intrekgebied van onze dekzandwinningen en tot zwaardere milieu-eisen omtrent grondgebruik?
Pagina 43 – paragraaf 5.1.2 Lozingen van diffuse bronnen
“In de rijkswateren veroorzaken beroep- en recreatievaart diffuse verontreinigingen met zware metalen, PAK’s en aangroeiwerende middelen zoals TBT en koper”
Vraag:
8. De KRW gaat uit van minimaal het stand-still principe! Kan de mogelijk diffuse verontreiniging van de recreatievaart een beperking opleveren voor de recreatieve ontwikkelingen rond de Bergse Haven?
Pagina 45 – paragraaf 5.1.2
‘In de regionale wateren speelt voorbelasting vooral een rol in o.a. de Zoom’
“Deze waterlichamen ontvangen water uit Vlaanderen dat onder meer belast is met stikstof en fosfor”
In dit kader verwijst de D66/BSD_fractie ook naar kaart 20 AB, waaruit blijkt dat bij de Zoom de belasting met PCB’s de norm (vanuit Vlaanderen) meer dan 5 x overschreden wordt.
Vraag:
9. De Zoom heeft grote ecologische waarden, maar is ook ernstig vervuild. Zijn status (sterk veranderd) leidt tot scherpere eisen. De inzet van het water van de Zoom kan bij verdere planontwikkelingen rond de Bergse Haven van belang zijn. In hoeverre wordt er gewerkt aan de concrete aanpak van de waterkwaliteit van de Zoom en in hoeverre worden de Vlaamse waterbeheerders daarop aangesproken en desnoods via juridische procedures gedwongen tot een terugbrenging van de belasting met nitraten, fosfaten en PCB’s?
Pagina 83 en 84 – paragraaf 7.2 t/m 7.2.1 Oppervlaktewaterlichamen
“Voor regionale waterlichamen die beschermd zijn op grond van de Vogel- of Habitatrichtlijn is geen risicoanalyse uitgevoerd”
Uit de tabel op pagina 84 blijkt dat ten aanzien van een fors aantal prioritaire stoffen er geen bepalingen zijn verricht aan monsters uit het Zoommeer/Eendracht-systeem.
Vraag:
10. Voor de verdere uitwerking van de plannen Bergse Haven is het van het grootste belang dat de actuele situatie van alle prioritaire stoffen wordt bepaald en de risicoanalyse wordt uitgevoerd. Juist de waterkwaliteit in het Zoommeer/Eendracht-systeem is belangrijk, alsmede de beoordeling wat de situatie in 2015 zal zijn. Is Uw College met de D66/BSD-fractie van mening dat het stand-still principe een bedreiging kan zijn voor de Bergse Haven plannen en dat een actuele situatiebepaling en risicoanalyse van het Zoommeer/Eendracht-systeem daarbij onontbeerlijk is?
Pagina 87 – paragraaf 7.2.1. Chemische toestand
“Uit de analyse blijkt dat ook in 2015 alle oppervlaktelichamen ‘at risk’ zijn, ondanks de lichte verbeteringen die zullen optreden door de uitvoering van het huidige beleid”
“Door meer auto’s op meer wegen zullen de emissies van PAK’s, lood en nikkel toenemen”
Vraag:
11. Zou het kunnen dat, net als bij de Europese luchteisen, de KRW leidt tot belemmeringen bij de realisering van plannen zoals de Bergse Haven?

Ook in deze tabel zijn een fors aantal stoffen niet meegenomen bij het Zoommeer/Eendracht-systeem.
De D66/BSD-fractie verzoekt Uw College bij de bevoegde autoriteiten/beheerders aan te dringen op een spoedige aanvulling van dit soort tabellen!
Voor de mogelijke ontwikkeling van de Bergse Haven c.q. toeristische ontwikkelingen rond het Zoommeer is het van het grootste belang dat deze cijfers, die zullen dienen als nulsituatie, er komen!
Pagina 93 – paragraaf 7.2.2. Ecologische toestand
“In de regionale wateren is de toestand van de biologische kwaliteitselementen matig tot slecht”
“In het Markiezaat en de Binnenschelde voldoen alle soortgroepen, behalve het fytoplankton, aan de norm”!
Zo slecht is de Binnenschelde dus nog niet!!
“In Zeeland veroorzaakt bovendien zoute kwel een voortdurende aanvoer van meststoffen vanuit het grondwater naar het polderwater. Het zoute water brengt in de bodem een chemische reactie teweeg waarbij meststoffen vrijkomen. Via de kwelstroom komen die vervolgens in het oppervlaktewater terecht”
Het voorgaande citaat laat zien wat er kan gebeuren als bijvoorbeeld het Zoommeer/
Eendracht-systeem zou verzilten. De zoute kwel die dan zou kunnen ontstaan in de Auvergnepolder kan dan daar kwaliteitsproblemen doen ontstaan!
Pagina 116 en 117 bijlage 1 – Overzicht betrokkenen
Van de 73 betrokkenen bij de 4 vergadergroepen vertegenwoordigde niemand specifiek de gemeente Bergen op Zoom. Slechts twee personen vertegenwoordigden een specifiek Brabants belang (gedeputeerde Verheijen en de heer Vos van het Waterschap Brabantse Delta). Van de ingezetenen van het stroomgebied woont circa 20 % in Noord-Brabant en circa 15 % in de gemeente Bergen op Zoom. Slechts één Bergenaar heeft korte tijd aan één der overleggroepen deelgenomen (collega Velthoen namens het Breed Overleg Deltawateren)
De D66/BSD-fractie kan slechts constateren dat, ondanks onze grote belangen bij het stroomgebied Schelde, de gemeente Bergen op Zoom bestuurlijk niet vertegenwoordigd was.
Vragen:
12. Is de gemeente Bergen op Zoom gevraagd op enige wijze bestuurlijk of ambtelijk betrokken te zijn bij één der vier overleggroepen?
13. Zo ja, waarom heeft Bergen op Zoom daar niet positief op gereageerd?
14. Zo nee, heeft Bergen op Zoom geprobeerd betrokken te geraken bij de totstandkoming van de karakterisering? Zo ja, hoe?
15. Hebben deelnemers aan de overleggroepen over de karakterisering met Uw College overleg gezocht?
16. Zo ja, wat was de inhoud daarvan?
Kaart 9
Op kaart 9 is de Binnenschelde ingekleurd als overig natuurgebied.
Vraag:
17. Is dit de juiste status van de Binnenschelde en heeft deze status effect op de ontwikkeling van de Bergse Haven?
Kaart 16AB
Wat opvalt op deze kaart is dat de fosforconcentratie in de Binnenschelde minder slecht is dan in de Oosterschelde of het Zoommeer/Eendracht-systeem!
Kaart 23
Geen toetsing prioritaire stoffen in de Binnenschelde!
Algemeen
Als het over de KRW en gemeenten gaat worden de gemeenten een aantal instrumenten toegedacht, te weten:
– kwaliteitsbaggeren
– effectmaatregelen
– rioleringsmaatregelen
– bouwverordening
Vraag:
18. Denkt de gemeente al na over haar rol in het kader van de KRW en de toepassing van bovengenoemde instrumenten en op welke termijn zal de raad hierbij betrokken worden?
Ad B Richtlijnen voor het milieueffectrapport Waterkwaliteit Volkerak-Zoommeer
Op pagina 11 van bijlage 2 (de antwoorden op de inspraakreacties) stelt het Ministerie dat het ambitieniveau van de initiatiefnemers is: de blauwalgenoverlast voor 2015 op te lossen.
Vraag:
19. Spoort dit ambitieniveau met de plannen Bergse Haven, mede met het oog op de peilbeheersing van de Binnenschelde met o.a. water uit het Volkerak/Zoommeer-systeem?

Bij de eerste vraag wordt gesproken over “een zoute situatie”.
Vraag:
20. Wat is de definitie van “een zoute situatie” in meer dan …. Cl mg/l ?

Op het kaartje staan de locaties van 5 peilbuizen. In tabel 2.3 worden slechts de analyseresultaten vermeld van de peilbuizen 1, 2 en 3.
Vraag:
21. Wat zijn de analyseresultaten van de peilbuizen 4 en 5 gelokaliseerd op/nabij het Nedalcoterrein?

“Aangezien er niet van elk boorpunt een analyseresultaat is, zijn op basis van de zintuiglijke waarnemingen extrapolaties gemaakt aangaande de bodemkwaliteit”
Een weinig wetenschappelijke en weinig betrouwbare methode. Alleen stoffen als PAK’s, aromaten en minerale oliën kunnen met de ogen en neus opgespoord worden, zij het zonder kwantitatieve gegevens. Bijvoorbeeld zware metalen blijven bij dit soort primitieve methoden buiten beeld! Voor een risicovol project als Bergse Haven een te beperkt onderzoek!

“In de waterbodem is fosfaat beschikbaar, waarmee het water belast wordt. In zoete wateren wordt fosfaat in het algemeen gebonden aan ijzer. In de waterbodem van de Binnenschelde gaan zwavel en ijzer verbindingen aan, waardoor fosfaat niet of in beperkte mate gebonden wordt aan het ijzer.
De aanwezigheid van de relatief grote hoeveelheid zwavel wordt verklaard door het feit dat de Binnenschelde een vroegere zeebodem is, waarin meer zwavel aanwezig is dan bij de waterbodem van zoet water. Door de ongunstige verhouding van ijzer, zwavel en fosfaat, houdt de waterbodem fosfaat slechts vast en kan er veel afgifte aan de waterfase plaatsvinden (via chemische en/of biologische routes)”
In dit citaat zit de oplossing van het enige probleem van de Binnenschelde. Zoete oplossingsrichtingen zijn o.a.
– afgraven zwavelhoudende bodemlaag
– afdekken zwavelhoudende bodemlaag
– zwavel/ijzer-concentratie bodem in balans brengen met de fosforconcentratie in het water door ijzer aan de bodem toe te voegen.
Zoete oplossingen zijn denkbaar, zowel voor de Binnenschelde als het Zoommeer/Volkerak-systeem!

Onder dit kopje worden woorden als “zal” en “zullen” te vaak en onjuist gebruikt. Het is geen zekerheid dat die visie wordt uitgevoerd! Besluitvorming is zelfs nog niet aan de orde!

“de Binnenschelde wordt in verbinding gebracht met het Zoommeer”.
Ook dit citaat is buitengewoon onzeker qua uitvoering.

“Deze of andere maatregelen zijn ongeacht de ontwikkeling van de Bergse Haven gewenst”.
Vraag:
22. Bedoeld zal toch zijn op zijn minst één der maatregelen? Allebei heeft geen zin!
Pagina 23 Toekomstige situatie
“”De scheepvaart zal het watersysteem belasten met stikstof en fosfaat”
Vraag:
23. Gezien het stand-still-principe van de KRW en het feit dat bij de KRW sprake is van een prestatieverplichting, is het dan denkbaar dat de verdere belasting van het watersysteem met stikstof en fosfaat door de scheepvaart een belemmering wordt voor de realisering van de Bergse Haven?
Pagina 24 Toekomstige situatie
Variant III spreekt de D66/BSD-fractie zeer aan!
Gezien het grote verschil tussen 11 Ha (toen) en 1 Ha (nu) als benodigde oppervlakte van het helofytenfilter komt een nadere toelichting op dit punt de D66/BSD-fractie als gewenst voor.
Pagina 30 Grondverzet
De in het plan niet bruikbare grond, totaal 445.000 m3 waarvan 145.000 m3 verontreinigd, alsmede de grote aanvoer van grond voor de leeflaag en geluidswal verontrust de D66/BSD-fractie. Met name de verwerking van de verontreinigde grond zal een zeer forse kostenpost betekenen.
De D66/BSD-fractie verzoekt Uw College ten aanzien van de grondstromen en de daaraan verbonden kosten en opbrengsten in de commissie financiën een nadere toelichting te geven, al is het maar indicatief!
Pagina 38 (driehoeksmosselen)
“….. er moet een voldoende harde ondergrond zijn”.
In principe is deze te creëren door bijvoorbeeld deels de bodem te bedekken met puin of steenslag!
In het besef dat deze brief veel vragen bevat, heeft de D66/BSD-fractie er begrip voor dat de in artikel 37 genoemde termijn bij de beantwoording van een aantal vragen problemen op kan roepen. Gefaseerde beantwoording c.q. reactie op de suggesties vindt de D66/BSD-fractie dan ook op voorhand acceptabel.
