Geacht Dagelijks Bestuur,
Sinds 2002 is de waterparagraaf een vast onderdeel van de nieuwe bestemmingsplannen. In het proces om te komen tot een nieuw bestemmingsplan wordt het Waterschap dan ook betrokken. Maar wat levert dit in feite op? Dus wat is de werkelijkheid ten opzichte van de papieren waarde van een bestemmingsplan?
Een voorbeeld uit Bergen op Zoom:
In het bestemmingsplan Het Fort Zeekant in paragraaf 3.6.2 staat in de toelichting op pagina 25 vermeld: “In het geval van nieuwbouw moet voor zowel de grondgebonden woningen, gestapelde woningen en voor de bedrijfspanden door de eigenaren een regenwateropvang worden gerealiseerd ten behoeve van toiletspoelingen, beregening van tuinen en voor autowassen. De buffercapaciteit van de voorziening dient ten minste 3.0 m3 per wooneenheid te bedragen.”.
De werkelijk is dat het voornoemde voorschrift niet in de praktijk wordt gebracht. Formeel omdat er bij pilotprojecten elders in het land foutieve aansluitingen zijn geweest, die hebben geleid tot ziektegevallen.
Mijn (off the record) informatie is dat aannemers en projectontwikkelaars dit soort voorschriften kostprijs opdrijvend vinden en er daarom niet aan mee willen werken. Het gebeurt nu alleen nog ‘op basis van vrijwilligheid en eigen initiatief’. Niet dus!
In nieuwe (Bergse) bestemmingsplannen komt deze paragraaf dan ook niet meer voor. Gelet op het feit dat de noodzaak van waterberging en hergebruik nog immer actueel is, vind ik het buitengewoon jammer dat een dergelijk voorschrift in nieuwe bestemmingsplannen (klaarblijkelijk met Uw toestemming) ontbreekt.
Wat ik ergerlijk vind, is dat zonder een formele aanpassing van een bestemmingsplan een onderdeel van de waterparagraaf door een gemeente ter zijde wordt geschoven, zonder dat dit leidt tot handhavingsacties c.q. verzoeken tot handhaving bij bijvoorbeeld de provincie.
Welke acties onderneemt Uw bestuur om de afspraken, gemaakt met gemeenten, die neergelegd zijn in bestemmingsplannen, ook feitelijk tot uitvoer te brengen?
Of is de waterparagraaf feitelijk vrijblijvend en eindigt de bemoeienis van het Waterschap bij de vaststelling van een bestemmingsplan?
