Geacht Dagelijks Bestuur,
Reeds een aantal jaren heeft het waterschap een wettelijke taak bij de totstandkoming van bestemmingsplannen, namelijk: advisering ten aanzien van de watertoets.
Voor ondergetekenden is het ondoorzichtig in hoeverre de waterschapsinbreng een effectieve is. Tot op heden hebben het algemeen bestuur in deze geen evaluaties bereikt.
Gezien het grote belang van een adequate omgang met de waterbelangen in bestemmingsplannen en de grote water(bergings)belangen waar de samenleving, en het waterschap in het bijzonder, voor staat, verzoeken ondergetekenden het dagelijks bestuur de effectiviteit van de waterschapsbijdrage in bestemmingsplannen te evalueren.
Vragen die middels een dergelijke evaluatie beantwoord dienen te worden zijn o.a.:
– Leggen alle gemeenten alle nieuwe bestemmingsplannen c.q. bestemmingsplanveranderingen voor aan het waterschap? Zo nee, welke niet?
– Wat is het beleid c.q. de aanpak van in deze onwillende gemeenten?
– Controleert het waterschap of de adviezen worden overgenomen?
– In hoeverre worden de waterschapsadviezen ten aanzien van de voorgelegde bestemmingsplannen c.q. bestemmingsplanwijzigingen overgenomen?
– Indien adviezen niet of niet geheel worden overgenomen, welke stappen heeft het waterschap dan ondernomen om dergelijke bestemmingsplannen, die niet (optimaal) waterproef zijn, alsnog veranderd te krijgen?
– Hoe vaak heeft het waterschap ten aanzien van het niet overnemen van de waterschapsadviezen bezwaar- of beroepsprocedures bij de betrokken gemeenten gevoerd c.q. bij de provincie? En in hoeveel van die gevallen heeft dat alsnog geleid tot de gewenste/geadviseerde aanpassingen?
– Is de effectiviteit van de watertoets al bij andere waterschappen/provincies geëvalueerd en met welke resultaten?
– Neemt het waterschap deel aan benchmarking van de effectiviteit van de watertoetsen? Is het DB op dit vlak bereid initiatieven te ontwikkelen?
– In hoeverre wordt het waterschap preventief bij de opstelling van bestemmingsplannen betrokken?
– In hoeverre maken gemeenten effectief gebruik van in het verleden door o.a. de rechtsvoorgangers van het waterschap opgestelde waterkansenkaarten? En maakt het waterschap bij de toetsing van de bestemmingsplannen daar nog gebruik van?
