OVER WATER 182: IK BEN NIET REKKELIJK
Over water 181 OVER TROTS EN SCHAAMTE van vorige week leverde een aantal reacties op die mij er toe brengen tot een nadere duiding van mijn stelling dat het opstellen van een ‘handreiking’ inzake klimaatadaptatie, door de RKC van het waterschap Brabantse Delta, volstrekt haaks staat op de in artikel 2 van de Verordening rekenkamercommissie waterschap Brabantse Delta omschreven “taak van de commissie”. “De commissie doet onderzoeken naar de doelmatigheid, doeltreffendheid en rechtmatigheid van het door het waterschapsbestuur gevoerde beleid en bestuur.” Artikel 2 van de verordening en artikel 182 van de Gemeentewet (“De rekenkamer onderzoekt de doelmatigheid, de doeltreffendheid en de rechtmatigheid van het door het gemeentebestuur gevoerde bestuur”) zijn gebiedend (“de commissie doet onderzoeken”) en (“de rekenkamer onderzoekt”) en limiterend (‘naar gevoerde (beleid en) bestuur’).
Er zijn ook andere geluiden. De VNG stelt bijvoorbeeld dat onderzoek naar toekomstig beleid wel zou kunnen, als een goede voorbereiding van het beleid bijdraagt aan de effectiviteit van het beleid. De Nederlandse Vereniging van Rekenkamers en Rekenkamercommissies (NVRR) stelt dat de wet onderzoek naar toekomstig beleid niet verbiedt en dat steeds meer rekenkamers dit doen. Ik ben het daar niet mee eens. In mijn beleving moet ieder woord in wet- en regelgeving serieus worden genomen. Dus ook het limiterende woord “gevoerde”. Dit is niet voor niets opgenomen en gesteld in de verleden tijd. Dat steeds meer rekenkamers wel onderzoek doen naar toekomstig beleid is voor mij geen valide argument. Als anderen een wet overtreden zonder dat de overheid ingrijpt, mag dat voor een rechtschapen burger geen rechtvaardiging zijn dan ook maar de wet te overtreden. Juist van overheden of aan overheden verbonden organisaties mag verwacht en geëist worden dat zij de wet naar geest en letter volgen. Het niet volgen van de wet door overheden, ondermijnd ‘de overheid’.
Ik verbaas mij keer op keer dat het argument gebruikt wordt: ”Er loopt de discussie over” of ”de wet wordt binnenkort wel aangepast”. Burgers en overheden dienen te handelen naar de op dat moment geldende wet- en regelgeving. Soms wordt de status van degenen die er over discussiëren gebruikt om het niet volgen van de wet te onderbouwen. De VNG, de NVRR, hoogleraar X, jurist Y, enz. Het zal mij ‘worst wezen’ wie iets betoogd. Als de 150 plus 75 in Den Haag een wet hebben vastgesteld, of de Staten, een gemeenteraad of een algemeen bestuur van een waterschap een verordening, is een wettelijke regeling gewoon geldig tot hij word ingetrokken of veranderd.
Al die personen die over bestaande wetgeving wel of niet zinnige, rechtvaardige of goede dingen zeggen, zijn niet de wetgever! Ze gaan er niet over. Het ‘ik wil er wel een uurtje over praten’ van de dijkgraaf in het AB van 24 april is aan mij niet besteed. Ik ben niet rekkelijk! Ik zal de geldende wettelijke bepalingen volgen en verwacht dat ook van een Kroonbenoemde dijkgraaf. Hij is net als een burgemeester of Commissaris van de Koning de representant van de Kroon. Staatsrechtelijk is zijn taak mede te zorgen dat het handelen van een AB conform wet- en regelgeving is. Artikel 2 van de verordening is niet vrijblijvend. Het artikel is, net als de hogere wetgeving waarop het is gebaseerd, gebiedend en limiterend. Een overheid die zijn billen afveegt aan wet- en regelgeving ondermijnd daarmee het eigen gezag en ook het gezag van de wetgever.
Een RKC die zich met toekomstig beleid gaat bemoeien handelt niet alleen in strijd met de wet- en regelgeving, maar komt ook in een mijn inziens ongewenste rol terecht. Zij wordt in zekere mate medeverantwoordelijk voor het beleid dat zij mogelijk in de toekomst zou willen onderzoeken.
