Geacht Dagelijks bestuur,
De gemeente Roosendaal is voornemens om een verklaring van geen bedenkingen af te geven voor het Zonnepark Evertkreekweg.

In het landschapsontwikkelingsplan “De Zoom van West-Brabant” is ter plekke een beekzone ingetekend.
-
Deze beekzone is in het Bestemmingsplan Buitengebied Roosendaal – Nispen aangegeven als een beschermingszone.
-
In de herziene beleidsvisie Zonne-energie wordt op pagina 30 de beekzone, zoals aangegeven in het landschapsontwikkelingsplan, aangegeven als beekdal.

In artikel 14 van de Verordening Ruimte Noord-Brabant (VR) is onderhavig gebied bestemd als reservering waterberging.

De aangevraagde omgevingsvergunning betekend feitelijk een afwijking van het bestemmingsplan.
Het is, naar mijn gevoelen, onwenselijk om in beekdalen zonneparken te realiseren in een strook van minimaal 100 meter aan weerszijden van een beek c.q in een gebied dat in de VR is aangeduid als “reservering waterberging”.
In de meeste bestemmingsplannen/landschapsbeleidsvisies van de gemeenten in ons werkgebied is een 100 meter strook als te beschermen zone ook opgenomen.

Is het waterschap om advies gevraagd?

Vindt het DB deze invulling van een gebied, dat aangewezen is als “reservering waterberging”, gezien de klimaatontwikkelingen, wenselijk c.q. acceptabel?

Is de eventuele mening van uw DB in deze kenbaar gemaakt aan de gemeente Roosendaal?

Is het mogelijk om een beschermingszone rond een beek te vrijwaren van bouwwerken als zonneparken, bijvoorbeeld via de keur?
