Het algemeen bestuur van het Waterschap Brabantse Delta in vergadering bijeen op
5 oktober 2007
Overwegende dat:
– het vaststellen van het aanbestedingsbeleid een bevoegdheid is van het algemeen bestuur;
– bij de uitvoering van aanbestedingen door het dagelijks bestuur het dagelijks bestuur zich heeft te houden aan het door het algemeen bestuur vastgestelde aanbestedingsbeleid;
– bij de aanbesteding van het gewijzigde plan Vierde Bergboezem gebruik wordt gemaakt van een “Design and Construct contract”;
– deze aanbestedingsmethode voor relatief eenvoudige werken niet passend is in het door het algemeen bestuur vastgestelde aanbestedingsbeleid;
– in de algemene bestuursvergadering op 27 juni 2007 de dijkgraaf heeft gezegd dat van de “Design and Construct”-methode van aanbesteding in de toekomst meer gebruikt gemaakt zal gaan worden, omdat het dagelijks bestuur ontwerp- en bestekactiviteiten meer wenst uit te besteden;
– marktanalyses aangeven dat toepassing van de “Design and Construct”-methode leidt tot beperking van de concurrentie tussen aannemers, omdat dan alleen aannemers met een eigen ontwerp-/ingenieursafdeling voor deelname aan de aanbesteding in aanmerking komen;
– de praktijk aangeeft dat bij toepassing van de “Design and Construct”-methode overwegend, zo niet uitsluitend, de grotere landelijk opererende aannemers de werken toegewezen krijgen;
– het van belang is dat ook regionale aannemers, zowel uit oogpunt van concurrentie, maar ook uit oogpunt van regionale werkgelegenheid, alle kansen krijgen.
Constaterende dat:
– uitbreiding van het gebruik van de “Design and Construct”-methode naar de relatief eenvoudige werken, een fundamentele wijziging is van het tot op heden gevoerde beleid;
– het voorgaande strijdig is met het door het algemeen bestuur vastgestelde beleid.
Spreekt als haar mening uit:
dat het dagelijks bestuur het klaarblijkelijk nieuwe aanbestedingsbeleid middels een nieuwe nota aanbestedingsbeleid dient voor te leggen ter vaststelling aan het algemeen bestuur,
en gaat over tot de orde van de dag.
