De Vogelrichtlijn stamt uit 1979. De Habitatrichtlijn uit 1992. Deze richtlijnen bestaan uit twee delen: soortenbescherming en gebiedsbescherming. Alle EU-lidstaten hadden de plicht ZELF beschermde gebieden aan te wijzen voor specifieke (leefgebieden van) (vogel-)soorten. De, door de overheden, onder beide richtlijnen aangewezen beschermde gebieden vormden het Natura 2000-netwerk.
De minister van Landbouw, Natuur en Voedselkwaliteit (LNV) is verantwoordelijk voor het aanwijzen van een Natura 2000-gebied en doet dat via een aanwijzingsbesluit.
In zo’n ministerieel besluit staat:

Wat beschermd wordt (welke habitattypen en plant- en diersoorten en hun leefgebieden);
-
Welke doelen gerealiseerd moeten worden (behoud, verbetering, uitbreiding);
-
De exacte begrenzing van het te beschermen gebied.
Dit alles gelet op de artikelen 10a en 15 van de Natuurbeschermingswet 1998;
De Nederlandse bijdrage aan het Europese netwerk van beschermde natuurgebieden (Natura 2000) bestaat uit 162 gebieden. Deze gebieden liggen zowel op het land als op zee. De meeste gebieden zijn inmiddels definitief aangewezen.
De referentiedatum is de datum waarop het Natura 2000-gebied onder de bescherming van de Habitatrichtlijn (92/43/EEG) is gekomen. Dit geldt ook voor gebieden die op grond van de Vogelrichtlijn (79/409/EEG) zijn aangewezen. Voor bijna alle Nederlandse Natura 2000 gebieden zijn de peildata vastgesteld in de periode 1994/2004. In de provinciale beleidsregels (intern en extern salderen) wordt de link gelegd met de referentiedatum. Overheden en andere belanghebbenden zoals landgebruikers en bedrijven weten dus vaak al 20 jaar wat de doelstellingen zijn!
De Kaderrichtlijn Water (KRW) is een andere tak van decennia wanbeleid.
De KRW is opgesteld om de waterkwaliteit in Europa te verbeteren. De richtlijn is sinds 2000 van kracht. In de richtlijn staan afspraken (die we als Nederland ZELF hebben opgesteld) die ervoor moeten zorgen dat uiterlijk in 2027 het water in alle Europese landen voldoende schoon en gezond is. Oorspronkelijk was de doelstelling van de KRW-realisatie in 2015. Toen dat niet haalbaar bleek is derogatie (met toestemming van de EU af te wijken van een algemeen vastgestelde norm) oftewel uitstel tot 2027 verleend! Het wordt steeds duidelijker dat de doelen grotendeels niet gehaald zullen worden, deels omdat ze onhaalbaar zijn.
De titel boven dit artikel en alle gegeven titelalternatieven gelden evenzeer voor de KRW-doelstellingen als voor de Natura 2000 doelstellingen.
In oktober 1897 werd er bij besluit van de Koningin-regentes een Staatscommissie ingesteld met de opdracht “te onderzoeken, welke maatregelen behooren te worden genomen ter voorkoming van, voor de volksgezondheid schadelijke, verontreiniging der openbare wateren en van dit onderzoek aan Hoogst Derzelve verslag uit te brengen, eventueel onder bijvoeging van één of meer wetsontwerpen”.
Bij de installatie van de commissie in de Trèves-zaal zei de minister van Binnenlandse Zaken onder meer: ”Alleen de samenwerking van mannen van wetenschap en praktijk op verschillend gebied kan leiden tot de oplossing van het hoogst moeilijk vraagstuk, dat aan Uw onderzoek is onderworpen.” en verder: ”Door dit onderzoek hoopt de Regeering U te zien komen tot de kennis van de eischen, die, ter voorkoming van eene voor de volksgezondheid schadelijke verontreiniging van openbare wateren, behooren gesteld te worden aan allen, maar inzonderheid aan openbare besturen of bijzondere inrichtingen, die zoodanige verontreiniging toelaten of veroorzaken. Deze eischen behooren geformuleerd te worden in wettelijke voorschriften, die tevens de noodige bepalingen moeten bevatten om de uitvoering te verzekeren en aangaande de voorziening tegen eventueel daaruit voortkomende moeilijkheden en geschillen.”
De voorzitter van de commissie van Lynden antwoordde de minister met o.m. de volgende uitspraken: “Al moge tot nog toe weinig zijn gebleken van de wetenschappelijke vaststelling van de schadelijkheid van in het water verspreid vuil van organischen oorsprong, geen wetenschappelijk man zal de ontkenning dier schadelijkheid voor zijn rekening willen nemen. Wie zal willen ontkennen, dat, onder den invloed van zoodanig water opstijgende giftige dampen, van menig leven de kracht en de energie gedoofd of het weerstandsvermogen gebroken en vooral menig kinderlijk leven, dat vreugde en licht in een huisgezin had kunnen brengen, geknakt werd?” en verder: “Zou Nederland, trotsch op zijnen wateren en op de macht waarmede het deze bedwingt, onmachtig blijken die wateren zuiver te houden in het belang van de bewoners des lands? Neen. Wij geloven met Uwe Excellentiën aan eene bevredigende oplossing.”
De commissie stelde vijf subcommissies in die elk een belangrijk aspect moesten onderzoeken en daarover moesten rapporteren. Op 29 juni 1901 werd een lijvig en degelijk rapport van ruim 200 pagina’s uitgebracht met als bijlagen onder meer de rapporten van de subcommissies.
Het geheel was “getuigend van inzicht en een ver vooruitziende blik.” Het bijgevoegde wetsontwerp, afgestemd op het ontwerp Gezondheidswet, werd in 1903/04 ingediend, maar nimmer behandeld en is in 1905 ingetrokken. Toen begonnen we reeds met achter de feiten aan blijven lopen. Wel plannen maken maar die slechts deels uitvoeren.
