Geacht Dagelijks bestuur,
In januari 2016 heeft een grondeigenaar wonende aan de Heul te Hoeven contact gezocht met het waterschap. De aanleiding waren de werkzaamheden aan de EVZ Kibbelvaart, hoek Oude Bredasepostbaan en de Heul en de vraag wat er met de te verplaatsten grond zou gebeuren. Ook informeerde hij naar de plannen met de door het waterschap aangekochte gronden gelegen ten zuiden van de Kibbelvaart en ten westen van De Heul.
De betrokken grondeigenaar en bewoner aan de Heul is (deels) de zuiderbuur van het door het waterschap aangekochte perceel. Die buur is teleurgesteld in de handelswijze van het waterschap toen en nu; ook de recente benadering van het frontoffice heeft wederom niet heeft geleid tot een – naar het gevoelen van de bewoner/buur – adequate reactie van het waterschap (geen opvolging). Op 7 juli 2020 heeft ondergetekende van betrokkene een kopiemail mogen ontvangen van een per die datum verzonden mail aan wederom het frontoffice.
Navraag deze week bij betrokkene heeft ondergetekende geleerd dat er nog geen opvolging heeft plaatsgevonden. Bij een bezoek ter plaatse kon ik waarnemen dat er vraagtekens zijn te stellen bij het nabuurschap c.q. het gebruik van het perceel in bezit van het waterschap.
Gedane zaken nemen geen keer. Maar de recente benadering van het frontoffice verdient wel een adequate opvolging.
Nu heeft de bewoner/eigenaar van de aangrenzende gronden het gevoel dat de pachter van het waterschapsperceel systematisch bezig is de kavelgrens (door wijze van ploegen) en de aangrenzende greppel te verplaatsen/dempen en heeft de bewoner steeds meer moeite het onderhoud van zijn deel van de oever op een gepaste wijze te verrichten.
Ondergetekende verzoekt uw DB de zorgplicht als perceelseigenaar serieus te nemen en de vraag in ogenschouw te nemen of het gebruik van een pachter van het perceel recht doet aan goed nabuurschap.
- Op welke wijze controleert het waterschap het gebruik van verpachte gronden in relatie tot haar buren?
- Is de huidige visuele perceelindeling/gebruik in overeenstemming met de kadastrale eigendomsrechten?
- Is de waarneming van de zuiderbuur dat de noordelijke oever van de scheidingsgreppel de afgelopen vijf jaar decimeters verplaatst is juist?
Mijn advies: ga op ambtelijk niveau eens praten met de zuiderbuur en kom nu wel de beloften tot een inhoudelijke opvolging na en kijk wat met de eerdere (2016) mails/contactformulier d.d.16-01-2016 14.45 uur is gebeurd. Gedane zaken nemen geen keer maar we kunnen er wel van leren.

Today, I went to the beach front with my children.
